American nightmare (and Cold Cave) vocalist Wesley Eisold is suing a WWE wrestler Cody “American Nightmare” RhodesWWE themselves and Fanatics’ commercial partner for alleged trademark infringement. By: Postwrestling.comthe lawsuit was filed on September 4.
Eisold Registered the American Nightmare trademark with the US Patent and Trademark Office in 2016 for use in music, apparel and entertainment services. Rhodes then in March 2019 registered the name American Nightmare for a wrestling activity, which was opposed; Eisold. Eisold and: Rhodes eventually settled the dispute in March 2021 and Rhodes brand name
But there were conditions attached Rhodesthe brand. Rhodes it was allowed to use the name American Nightmare on its products as long as they “emphatically use Rhodesname, likeness, or wrestling-related imagery at least 75% larger than the text of “American Nightmare.” Eisold now claims it RhodesWWE and Fanatics violated those terms.
“WWE and wrestling fans continue to tag frequently [social media accounts for the musical band] The American nightmare on Facebook and social media posts,” Eisold’s complaint states.
“To this day, Runnels and American Nightmare fans still buy Runnels clothing. Fans who attend American Nightmare concerts and other events, including in California and specifically this court circuit, wear both Runnels clothing and Eisold clothes”.
Eisold He is seeking at least $150,000 in damages, up to treble $300,000 in damages, alleging infringement of his federal trademark. Eisold has since commented on the matter via The Cold cave Twitter: “Listen, you dolts! I already own the name. It doesn’t matter who you love. They licensed it from me. Then they broke the contract.”
